In a fun win for our colleagues at Nicholes Family Law, the Full Court of the Family Court upheld the Trial Judge, Justice Macmillan’s judgement and found that the Australian Financial Agreement (‘prenuptial agreement’) the $63m Australian husband and his $3m Indonesian wife of 8 months signed on their actual wedding day, at a time when the wife was pregnant, (which provided for each of them to keep what they had if they were to ever separate ie. she keeps property she had purchased in Indonesia with $3m the husband gave to her prior to marriage; and he keeps his $63m), prevented the husband from issuing legal proceedings in Indonesia trying to recover some of the $3m he had gifted her prior to marriage.
